SYNOPSIS

     Prohibits adoption of certain rules and regulations by State agencies prior to July 1, 2010.

An Act concerning the adoption of certain rules and regulations.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Notwithstanding any law, or rule or regulation adopted pursuant thereto, to the contrary, no State agency shall adopt any new rule or regulation, or any amendment to an existing rule or regulation, prior to July 1, 2010, unless the Governor issues an executive order determining that the new, or amended, rule or regulation is necessary and that the State agency may proceed with the rule-making in accordance with the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.).

     b.    As used in this section, "State agency" means the same as the term is defined pursuant to section 2 of P.L.1968, c.410 (C.52:14B-2).

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would place a moratorium on the adoption of any new rules or regulations, or amendments to existing rules or regulations, by any State agency prior to July 1, 2010, unless the Governor issues an executive order determining that the new, or amended, rule or regulation is necessary and that the State agency may proceed with the rule-making in accordance with the "Administrative Procedure Act."
