SYNOPSIS
Permits reuse of returned prescription drugs within licensed health care facilities; directs Commissioner of Health to evaluate feasibility of reuse for treatment of indigent persons.

An Act concerning reuse of returned prescription drugs under certain circumstances and supplementing Title 24 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Unopened, unexpired prescription drugs dispensed to, but not used by, a patient within a licensed health care facility, may be reused at the facility in accordance with regulations issued by the Commissioner of Health, after consultation with the New Jersey State Board of Pharmacy.
2. The Commissioner of Health, in consultation with the New Jersey State Board of Pharmacy, shall evaluate the feasibility of establishing a program to utilize unopened, unexpired prescription drugs for the treatment of indigent persons by clinics, participating physicians, general hospitals, community health centers, or other providers, and report his findings and recommendations to the Legislature no later than one year following the effective date of this act.
3. This act shall take effect on the first day of the sixth month after enactment.
STATEMENT
This bill provides that unopened, unexpired prescription drugs dispensed to, but not used by, a patient within a licensed health care facility, may be reused at the facility in accordance with regulations issued by the Commissioner of Health, after consultation with the New Jersey State Board of Pharmacy. In addition, the bill specifies that the Commissioner of Health, in consultation with the New Jersey State Board of Pharmacy, shall evaluate the feasibility of establishing a program to utilize unopened, unexpired prescription drugs for the treatment of indigent persons by clinics, participating physicians, general hospitals, community health centers, or other providers.
