STATE OF NEW JERSEY

SYNOPSIS

     Organizes the General Assembly for the Two Hundred and Sixteenth Legislature and amends certain Assembly Rules.

An Assembly Resolution organizing the General Assembly for the Two Hundred and Sixteenth Legislature.

 

     Be It Resolved by the General Assembly of the State of New Jersey:

 

     1.    That the Clerk of the General Assembly be directed to inform the Senate that the General Assembly has organized, its Speaker being the Honorable Vincent Prieto of Hudson County, its Speaker pro tempore, Jerry Green of Union County, and its Clerk, Dana M. Burley of Camden County, for the Two Hundred and Sixteenth Legislature, and has proceeded to business.

 

     2.    That the Speaker be and is hereby authorized to appoint such assistants as the Speaker may deem necessary.

 

     3.    That the working staff of the General Assembly shall be at all times subject to the direction of the Speaker and the Clerk, who shall have authority to designate to any member of the staff such duties as may be required.

 

     4.    That unless otherwise ordered the regular hours of meetings of the General Assembly will be on days and at times to be announced to the members, the news media and the public by the Speaker.

 

     5.    That no floor passes be issued by any officer or member of the General Assembly other than the Speaker, with the further provision that the privilege of the floor may be extended by a resolution duly adopted.

 

     6.    That in the absence of the Clerk, such other officers or employees as directed by the Speaker shall perform all duties imposed by law and the Rules of the General Assembly upon the Clerk.

 

     7.    That the Bill Drafting Manual prepared and revised from time to time by the Office of Legislative Services, be adopted as the official manual of practice and procedure of the General Assembly governing the form of bills to be introduced in the General Assembly and governing the conduct of the preliminary examination of bills proposed for introduction in the General Assembly required by the Rules of the General Assembly.  A copy of the revised manual shall be provided to the Clerk.


     That in order to carry out the aforementioned practice and procedure, the Legislative Counsel and such deputies and assistants as he shall assign be designated as counsel to conduct said preliminary examination of bills proposed for introduction and amendments adopted in the General Assembly under the general supervision of the Legislative Counsel.

 

     8.    That each member of the General Assembly be authorized to retain up to six aides at a total compensation per member as authorized by law, except the Speaker may authorize more than six aides.

 

     9.    That the Rules of the General Assembly for the Two Hundred and Fifteenth Legislature be adopted as the Rules of the General Assembly for the Two Hundred and Sixteenth Legislature with the following changes:

 

·       Rule 4:6 is amended to read as follows:

 

4:6.      Appoint Committees, Substitutes.

The Speaker shall appoint all committees in accordance with Rule 10:1, unless otherwise directed by the General Assembly. The Speaker may, during the inability of a committee member [of any committee] or a subcommittee member [of the Appropriations Committee] to serve, appoint another member to serve during that period.

 

·       Rule 10:1 is amended to read as follows:

 

     10:1            Committees and Membership.

            The following Standing Reference, Administrative and Joint Committees shall be appointed by the Speaker at the commencement of each annual session.  The number of members of the General Assembly on each committee is indicated by the number following the name of the committee.

·       Rule 13:6 is amended to read as follows:

 

13:6.    Motions Decided Without Debate.

The following motions are decided without debate:

 

a.   to adjourn (Rule 13:5);

 

b.   for a call of the General Assembly (8:1);

 

c.   to terminate debate (Rule 13:9); [and]

 

d.   to lay on the table[.];

 

e.   questions of order (Rule 4:4);

 

f.    to appeal the ruling of the chair in calling a member to order (Rule 7:4);

 

g.   to appeal the ruling of the chair in determining whether a motion is a main motion, procedural motion or incidental motion (Rule 7:7c); and

 

h.   incidental questions of order arising while a motion to terminate debate is pending (Rule 13:9d).

 

·       Rule 15:16 is amended to read as follows:

 

15:16. Floor Amendments.

a.   Except by special order of the Speaker, no motion for a floor amendment and no motion to return a bill or resolution to second reading for the purpose of amendment is in order unless the sponsor of the amendment, at least one hour prior to the motion delivers a copy of the proposed amendment to the Clerk and the Majority and Minority Leaders.

 

b.   No motion to approve an amendment to a bill or resolution shall be considered unless copies are available to the members prior to consideration.

 

c.   The text of the proposed amendments does not need to be read by the Clerk unless requested by the sponsor or ordered by the General Assembly. The sponsor of any amendment shall include with the amendment a statement describing its effect.

d.   With the prior agreement of the Majority and Minority Leaders, motions to return bills and resolutions to second reading for the purpose of amendment may be consolidated into one motion and motions to amend bills and resolutions may be consolidated into one motion.

 

(1)  The Speaker shall designate a member to make the consolidated motions;

 

(2)  If any member objects promptly after the consolidated motion is moved to the inclusion of any bill or resolution in the consolidated motion to return to second reading, the bill or resolution objected to shall be removed from the consolidated motion to return to second reading and the subsequent consolidated motion to amend; and

 

(3)  The Clerk shall read the bill and resolution numbers, but it shall not be necessary for the Clerk to read the record on each of the bills and resolutions.  Instead, the Clerk may state that all bills and resolutions in the consolidated motion are currently on second reading in the General Assembly.

 

     10.  That His Excellency the Governor be informed that the General Assembly has organized for the Two Hundred and Sixteenth Legislature, its Speaker being the Honorable Vincent Prieto of Hudson County, its Speaker pro tempore being Jerry Green of Union County, and its Clerk being Dana M. Burley of Camden County, and is now ready to proceed to business and to receive any communications he may forward.

 

     11.  That due to the fact that Amy H. Handlin, a member from District 13, has been unable to appear in person at the organization of the General Assembly for the Two Hundred and Sixteenth Legislature to be sworn as a member, and there being no contest or question as to her election, the Speaker, or a member of the General Assembly named by him, is authorized to administer the oath of office and allegiance in the usual form to Amy H. Handlin at a mutually agreeable location within the State of New Jersey, and that the oath when administered as herein authorized shall be accepted and received by this House as the oath of office and allegiance of Amy H. Handlin.

 

     12.  This resolution shall take effect immediately.
