SYNOPSIS

     Directs PANYNJ to conduct noise and land use compatibility studies at Newark, Teterboro, and Atlantic City airports and to hold public hearings on aircraft noise issues.

A Concurrent Resolution directing the Port Authority of New York and New Jersey to conduct noise and land use compatibility studies at certain airports.

 

Whereas, The Port Authority of New York and New Jersey (Port Authority) is a bi-state agency established by compact between the State of New York and the State of New Jersey; and

Whereas, In order to amend the compact creating the Port Authority, New York and New Jersey are required to each adopt legislation of identical effect; and

Whereas, Assembly Bill No. 4355 of the 2012-2013 New Jersey Legislative session, required the Port Authority to conduct noise and land use compatibility surveys at its airports, to report these findings to the governors and legislatures of New York and New Jersey, and to hold public hearings in both states to allow for public comment on aircraft noise issues; and

Whereas, Assembly Bill No. 4355 of the 2012-2013 Legislative session was released by the Assembly Transportation, Public Works, and Independent Authorities Committee on November 23, 2013, was passed by the General Assembly on December 19, 2013, and was referred to the Senate for further consideration; and

Whereas, On November 23, 2013, however, the Governor of New York vetoed identical legislation which had passed through the New York State Legislature, effectively ending consideration of the bill in New Jersey since it would no longer be possible to have legislation of identical effect enacted in both states; and

Whereas, In the veto message, Governor Cuomo indicated that he would direct the Port Authority to conduct the noise and land use compatibility surveys at LaGuardia and John F. Kennedy airports so that the surveys would not be reliant upon the passage of identical legislation in New Jersey; and

Whereas, It is equally important to the citizens of the region that these noise and land use compatibility surveys be conducted at the Port Authority airports in New Jersey; and

Whereas, Noting that Governor Cuomo directed the Port Authority to conduct the noise and land use compatibility studies without New Jersey's concurrence, this Legislature similarly directs the Port Authority to conduct noise and land use compatibility studies at Newark Liberty International Airport, Teterboro Airport, and Atlantic City International Airport; now, therefore,

 

     Be It Resolved by the General Assembly of the State of New Jersey (the Senate concurring):

 

     1.  a.  This Legislature directs the Port Authority of New York and New Jersey to conduct noise and land use compatibility studies for Newark Liberty International Airport, Teterboro Airport, and Atlantic City International Airport.  The studies shall be conducted in a manner outlined in federal aviation regulations, as set forth in 14 C.F.R. s.150, and shall recommend operational and land use measures to improve the compatibility of air terminals with surrounding land uses.

     b.  This Legislature further directs the Port Authority to submit to the Governor and the Legislature the reports detailing the Port Authority's findings pursuant to those studies no later than June 1 in the year following the adoption of this resolution.

     c.  Finally, this Legislature directs the Port Authority to hold public hearings at which members of the public shall have the right to be heard regarding aircraft noise issues at Newark Liberty International Airport, Teterboro Airport, and Atlantic City International Airport.  The public hearings shall be held in Union, Essex, and Atlantic Counties in the State of New Jersey and shall be attended by the Executive Director, Deputy Executive Director, and at least one commissioner appointed by New Jersey.  The Port Authority shall develop amendments and changes to the reports required by this resolution as may be necessary and practicable to address public input.

 

     2.    Copies of this resolution, as filed with the Secretary of State, shall be transmitted by the Clerk of the General Assembly or the Secretary of the Senate to every member of the Board of Commissioners of the Port Authority of New York and New Jersey and to the Executive Director and Deputy Executive Director of the Port Authority.

 

 

STATEMENT

 

     This resolution directs the Port Authority of New York and New Jersey (Port Authority) to conduct noise and land use compatibility studies at Newark Liberty International Airport, Teterboro Airport, and Atlantic City International Airport.  The studies are to be conducted in a manner outlined in federal aviation regulations, as set forth in 14 C.F.R. s.150, and are to recommend operational and land use measures to improve the compatibility of air terminals with surrounding land uses.  The studies are to be submitted to the Governor and the Legislature.  In addition, the resolution directs the Port Authority to hold public hearings at which members of the public can be heard regarding aircraft noise issues at Newark Liberty International Airport, Teterboro Airport, and Atlantic City International Airport.

     New Jersey considered legislation to amend the Port Authority's enabling compact in the 2012-2013 Legislative session.  The legislation required the Port Authority to conduct these noise and land use studies at all of its airports.  In order to amend the compact, identical legislation has to be enacted by both New York and New Jersey.  However, New York's Governor vetoed similar legislation which had passed both houses of the New York legislature and instead directed the Port Authority to conduct these studies at LaGuardia and John F. Kennedy airports in New York.  This resolution would require the noise and land use studies at the Port Authority airports in New Jersey.
