     Approves New Jersey Building Authority projects concerning exterior envelope restoration to Executive State House and relocation of mechanical and electrical equipment in State House Garage.

A Concurrent Resolution expressing the approval of the Legislature for project reports, entitled "Exterior Envelope Restoration and Repairs for the New Jersey Executive State House" and "Relocation of the Mechanical and Electrical Equipment Room in the New Jersey State House Garage," by the New Jersey Building Authority and expressing the sense of the Legislature that the projects described in the reports should be financed and managed by the authority.

 

Whereas, Pursuant to the "New Jersey Building Authority Act," P.L.1981, c.120 (C.52:18A-78.1 et seq.), the New Jersey Building Authority is authorized to undertake projects as defined in the act; and

Whereas, The authority has determined that it is desirable and in the best interests of the authority to undertake certain improvements to the Executive State House, located at 125 West State Street, Trenton, New Jersey, described in the authority project report entitled "Exterior Envelope Restoration and Repairs for the New Jersey Executive State House" and consisting of measures to preserve the structural viability of the Executive State House, repair the ongoing water infiltration issues, permanently fix the various areas of temporary repairs, perform deferred maintenance, and restore the entire exterior envelope of the Executive State House; and

Whereas, The authority has further determined that it is desirable and in the best interests of the authority to undertake certain improvements to the State House Garage, located at 165 West State Street, Trenton, New Jersey, described in the authority project report entitled "Relocation of the Mechanical and Electrical Equipment Room in the New Jersey State House Garage" and consisting of measures to relocate the electrical and mechanical equipment in the New Jersey State House Garage to an area within the State House complex that is above the 100-year floodplain level; and

Whereas, When proposing to undertake any project whose cost is estimated to exceed $100,000, the authority must comply with the provisions of the act by, among other things, preparing a project report, submitting the project report to the New Jersey Commission on Capital Budgeting and Planning for its review and findings, holding a public hearing in the municipality where the project is to be located, and submitting to the State Legislature the project report together with the findings of the Commission on Capital Budgeting and Planning, and a transcript of the public hearing; and

Whereas, On May 29, 2012, the Commission on Capital Budgeting and Planning approved the project reports referenced herein that describe the projects that the authority desires to undertake; and

Whereas, The authority will fund the Executive State House project through authority financing and will fund the State House Garage project either through authority financing or grant funding from FEMA or both; and

Whereas, The act requires that a project to be undertaken by the authority be approved by the Legislature within 45 days of submission, or the next meeting date immediately thereafter for a house not meeting on that date, or else the project shall be deemed disapproved; and

Whereas, The project report entitled "Exterior Envelope Restoration and Repairs for the New Jersey Executive State House" proposes the following project:

     Location - The New Jersey Executive State House, located at 125 West State Street, Trenton, New Jersey;

     Description - Preserving the structural viability of the Executive State House, repairing the ongoing water infiltration issues, permanently fixing the various areas of temporary repairs, performing deferred maintenance, and restoring the entire exterior envelope of the Executive State House;

     Agencies proposed for use - The Office of the Governor and the various offices within the Office of the Governor, the Office of Counsel to the Governor, the Office of the State Treasurer, and the Office of the Secretary of State;

     Projected costs - $37.9 million; and

Whereas, The project report entitled "Relocation of the Mechanical and Electrical Equipment Room in the New Jersey State House Garage" proposes the following project: 

     Location - The New Jersey State House Garage, located at 165 West State Street, Trenton, New Jersey; 

     Description - Relocating electrical and mechanical equipment to an area within the State House complex that is above the 100-year floodplain level; 

     Projected costs - $6.3 million; and

Whereas, The project described in the authority project report entitled "Exterior Envelope Restoration and Repairs for the New Jersey Executive State House" has a current total working estimated cost of $37.9 million funded through authority financing, but the ultimate costs will depend upon the results of contract bidding following the final design, and could be as much as 10 to 15 percent above the current project cost estimate; and

Whereas, The project described in the authority project report entitled "Relocation of the Mechanical and Electrical Equipment Room in the New Jersey State House Garage" has a current total working estimated cost of $6.3 million funded through authority financing and/or potential grant funding to be received from FEMA for this proposed project, but the ultimate costs will depend upon the results of contract bidding following the final design, and could be as much as 10 to 15 percent above the current project cost estimate; now, therefore,


Be It Resolved by the General Assembly of the State of New Jersey (the Senate concurring):

 

     1.  The Legislature hereby approves the New Jersey Building Authority's project reports entitled "Exterior Envelope Restoration and Repairs for the New Jersey Executive State House" and "Relocation of the Mechanical and Electrical Equipment Room in the New Jersey State House Garage."  Approval of the reports shall constitute approval of the respective projects described therein for the purposes of subsection b. of section 8 of P.L.1981, c.120 (C.52:18A-78.8).  This approval shall be deemed to include changes or modifications to the projects as to architectural or engineering designs, or changes in the needs of the executive agencies, which such agencies indicate are necessary; provided that such changes or modifications do not materially change the scope or use of the projects or materially increase the cost as described in the project reports after adjustments for the effects of inflation in the construction industry.

 

     2.  It is the sense of the Legislature that the New Jersey Building Authority's projects should be funded by authority project funds and, if eligible therefore, federal funds, and managed directly by the authority, with delegation to other state agencies of managerial responsibility only where the authority deems it necessary, but with full control over project management retained by the authority.

 

     3.  Duly authenticated copies of this concurrent resolution, signed by the Speaker of the General Assembly and attested by the Clerk thereof, and signed by the President of the Senate and attested by the Secretary thereof, shall be transmitted to the New Jersey Building Authority.

 

 

STATEMENT

 

     This concurrent resolution approves the New Jersey Building Authority's project reports entitled "Exterior Envelope Restoration and Repairs for the New Jersey Executive State House" and "Relocation of the Mechanical and Electrical Equipment Room in the New Jersey State House Garage."  Approval by the Legislature is required by the provisions of the "New Jersey Building Authority Act" before the authority can undertake a project.
