SYNOPSIS

     Urges President to rescind Executive Order 13575 establishing White House Rural Council.

A Concurrent Resolution urging the President to rescind Executive Order 13575 which establishes the White House Rural Council.

 

Whereas, Executive Order 13575, signed by President Barack Obama on June 9, 2011, establishes the White House Rural Council to expand the role of the Federal Government in rural communities across America; and

Whereas, The stated policy of Executive Order 13575 is as follows: "The Federal Government has an important role to play in order to expand access to the capital necessary for economic growth, promote innovation, improve access to health care and education, and expand outdoor recreational activities on public lands"; and

Whereas, The White House Rural Council is comprised of the heads of many of the most powerful departments and agencies in the Federal Government and does not include any farmers or agricultural property owners who live in the rural communities that would be directly affected by the policies of the Council; and

Whereas, Executive Order 13575, through its creation of the White House Rural Council, allows the Federal Government to overreach its power and exert top-down control over nearly every aspect of rural America, where 16 percent of the American population lives; and

Whereas, People who reside and make their livelihood in the rural communities of America should be free to live, work, farm, own property, and manage their resources and affairs without intrusive interference by the Federal Government; and

Whereas, Rural policy and planning matters discussed in Executive Order 13575, including energy, food, education, health care, and resource use, should be managed by the residents of these rural communities as well as the state and local governments that are intimately familiar with these rural communities; and

Whereas, Land usage and economic development in rural America should be left up to property owners and free enterprise; and

Whereas, Executive Order 13575 is in direct contravention of the Ninth and Tenth Amendments to the United States Constitution, which explicitly reserve to the states and the people the rights and powers not delegated to the United States; and

Whereas, If the President refuses to act within the bounds of the Constitution, Congress should use the power of the purse to deny approval of funding necessary to carry out the policy measures contained in Executive Order 13575; and

Whereas, The balance between the appropriate role of the Federal Government and the rights of the states and the people must be preserved; now, therefore,

 

     Be It Resolved by the General Assembly of the State of New Jersey (the Senate concurring):

     1.  The President of the United States is respectfully urged to rescind Executive Order 13575, which establishes the White House Rural Council and overreaches the role of the Federal Government into rural America.

 

     2.  If the President does not rescind Executive Order 13575, Congress is respectfully urged not to approve funding that would be necessary to carry out the policy measures contained within the Executive Order.

 

     3.  Duly authenticated copies of this concurrent resolution, signed by the Speaker of the General Assembly and the President of the Senate and attested by the Clerk of the General Assembly and the Secretary of the Senate, shall be transmitted to the President of the United States, the Majority and Minority Leaders of the United States Senate, the Speaker and Minority Leader of the United States House of Representatives, and every member of Congress elected from this State.

 

 

STATEMENT

 

     This concurrent resolution urges the President of the United States to rescind Executive Order 13575, dated June 9, 2011, which establishes the White House Rural Council.  If the President does not rescind the Executive Order, this resolution urges Congress not to approve the funding that would be necessary to carry out the policy measures contained in the Order.

     The White House Rural Council created by Executive Order 13575 is comprised of heads of the most powerful departments and agencies in the nation and allows the Federal Government to overreach its authority and exert top-down control over nearly every aspect of rural America, where sixteen percent of the American population resides.  Rural planning and policy matters are best addressed by the local governments familiar with these rural communities, and the people who reside in these areas should be free to work, farm, and manage their affairs and property without intrusive federal interference.  Consistent with the Ninth and Tenth Amendments to the United States Constitution, the proper balance between the role of the Federal Government and the rights of the states and the people must be preserved.
