     Establishes durational time limits for receipt of Supplemental Nutrition Assistance Program (SNAP) benefits.

An Act concerning eligibility for Supplemental Nutrition Assistance Program benefits and supplementing Title 44 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  A recipient's eligibility for benefits under the New Jersey Supplemental Nutrition Assistance Program established pursuant to the federal "Food and Nutrition Act of 2008," Pub.L.110-246 (7 U.S.C. s.2011 et seq.) shall be limited as follows:

     (1)   A recipient shall receive benefits for no more than 36 consecutive months.  Upon receiving benefits for 36 consecutive months, the recipient shall be ineligible for benefits for the following 12 consecutive months; and

     (2)   A recipient shall receive a lifetime cumulative total of no more than 60 months of benefits.

     b.    A recipient shall be exempted from the time limits established pursuant to subsection a. of this section if the recipient is:

     (1)   70 years of age or older;

     (2)   permanently disabled, including, but not limited to, a person eligible for Supplemental Security Income or disability insurance benefits under Title II of the federal Social Security Act (42 U.S.C. s.401 et seq.), as defined by regulation of the commissioner; or

     (3)   a veteran, as that term is defined in N.J.S.11A:5-1.

     c.     The Commissioner of Human Services shall enforce the provisions of this section to the extent that such provisions are not inconsistent with federal law.

 

     2.    This act shall take effect on the first day of the fourth month next following the date of enactment.

 

STATEMENT

 

     This bill establishes durational time limits for receipt of benefits under the New Jersey Supplemental Nutrition Assistance Program (SNAP).

     Recipients would be limited to receiving 36 consecutive months of SNAP benefits, after which time the person would become ineligible for SNAP benefits for the following 12 months.  Recipients would additionally be limited to receiving a cumulative lifetime total of 60 months of SNAP benefits. 

     These time limits would not apply to a person who is 70 years of age or older, permanently disabled, or a veteran.  The Commissioner of Human Services would be required to enforce the provisions of the bill to the extent that the provisions are not inconsistent with federal law.
