     Requires State and county correctional facilities to provide inmates free menstrual hygiene products.

An Act concerning menstrual hygiene products in correctional facilities and supplementing Title 30 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  The Commissioner of Corrections shall require that menstrual hygiene products be made available in the commissary, medical department, or other appropriate common area to any inmate who menstruates upon the inmate's request and at no cost to the inmate.  There shall be no conditions or restrictions imposed on an inmate's access to menstrual hygiene products.   

     b.    For the purposes of this section, "menstrual hygiene products" include tampons, menstrual pads, sanitary napkins, and pantiliners.

 

     2.    a.  The chief executive officer or warden of each county correctional facility shall require that menstrual hygiene products be made available in the commissary, medical department, or other appropriate common area to any inmate who menstruates upon the inmate's request and at no cost to the inmate.  There shall be no conditions or restrictions imposed on an inmate's access to menstrual hygiene products.   

     b.    For the purposes of this section, "menstrual hygiene products" include tampons, menstrual pads, sanitary napkins, and pantiliners.

 

     3.    This act shall take effect immediately. 

 

 

STATEMENT

 

     This bill requires State and county correctional facilities to provide free menstrual hygiene products to any inmate who menstruates. 

     The bill specifically requires the Commissioner of Corrections in State correctional facilities, or the chief executive officer or warden in county correctional facilities, to make available to menstruating inmates, at their request and free of charge, menstrual hygiene products in the commissary, medical department, or other appropriate common area.  The bill prohibits conditions or restrictions from being imposed on a menstruating inmate's access to these products. 

     The bill defines "menstrual hygiene products" as tampons, menstrual pads, sanitary napkins, and pantiliners.
