SYNOPSIS
Requires State superintendent of NJ Office of Weights and Measures to inspect baggage scales at certain airports within State.

An Act concerning baggage scales at certain airports within the State, supplementing Title 51 of the Revised Statutes, and amending R.S.51:1-65.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. (New section) a. As used in this section:
"Baggage scale" means a weight or measure used to assess the weight of passenger baggage in connection with commercial air transportation.
"Qualified airport" means an airport located, in whole or in part, in a city of the first class within the State, which airport contains multiple airport terminals, including, but not limited to, an international airport terminal.
b. Notwithstanding the provisions of R.S.51:1-65 to the contrary, the State superintendent and assistant superintendents shall inspect, or cause to be inspected, each baggage scale at a qualified airport at least once each year. The owner of a baggage scale, including an airline carrier or the operator of the qualified airport, shall assist the State superintendent and assistant superintendents with an inspection undertaken pursuant to this subsection. Upon request by the State superintendent and assistant superintendents, the county or municipal superintendent in which a qualified airport is located shall assist with an inspection undertaken pursuant to this subsection.
c. Within 30 days of the completion of an inspection pursuant to subsection b. of this section, the State superintendent and assistant superintendents shall post on the Internet website of the New Jersey Office of Weights and Measures a summary of the following information for each qualified airport:
(1) the total number of baggage scales;
(2) the number of baggage scales inspected, including the number of baggage scales that failed inspection;
(3) the number of baggage scales that have failed two or more consecutive inspections, if applicable; and
(4) any other information the State superintendent and assistant superintendents deem necessary.
2. R.S.51:1-65 is amended to read as follows:
51:1-65. Each county or municipal superintendent shall procure, at the expense of [said] the county or municipality, a set of legal standards, properly certified by the [state] State superintendent, and the necessary testing and sealing apparatus. [He] The county or municipal superintendent shall take charge of [said] the legal standards [and of] , all copies [thereof] of the legal standards, and [of] all testing and sealing apparatus and shall take all precautions necessary for their safe-keeping and for their maintenance in good order. [He] The county or municipal superintendent shall cause an inspection of the weights and measures used in trade within [his] the county or municipal superintendent's jurisdiction [to be made] at least once [in] each year, except as otherwise provided in subsection b. of section 1 of P.L. , c. (C. ) (pending before the Legislature as this bill). The [state] State superintendent and [his] assistant superintendents shall direct and assist the county and municipal superintendents in making inspections.

3. This act shall take effect immediately.
STATEMENT
This bill requires the State superintendent and assistant superintendents of the New Jersey Office of Weights and Measures (office) to inspect, or cause to be inspected, baggage scales at a qualified airport at least once each year. The bill requires the State superintendent and assistant superintendents, within 30 days of a completed inspection, to publish on the office's Internet website a summary of certain information concerning the inspection of baggage scales at such airports, as outlined in the bill. Under the bill, a "qualified airport" means an airport located, in whole or in part, in a city of the first class within the State, which airport contains multiple airport terminals, including, but not limited to, an international airport terminal.
