SYNOPSIS
Prohibits imposition of different premium rates for disability insurance based on race, creed, color, sex, or other protected characteristic.

An Act concerning disability insurance premium rates and supplementing P.L.1945, c.169 (C.10:5-1 et seq.).
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. An insurer authorized to issue or an insurance producer authorized to sell, solicit, or negotiate policies or contracts against disability from injury or disease in this State shall not make a distinction or otherwise discriminate between the parties, reject an applicant, cancel a policy or demand, or impose a higher rate of premium for a policy or contract against disability from injury or disease that is delivered, issued, executed, or renewed in the State on the basis of an applicant's or insured's race, creed, color, national origin, or sex.
b. Any violation of this act shall constitute a violation of P.L.1960, c.39 (C.56:8-1 et seq.).
c. As used in this section, "insurer" and "insurance producer" mean the same as defined pursuant to section 3 of P.L.2001, c.210 (C.17:22A-28).
2. This act shall take effect on the 90th day next following enactment and shall apply to policies or contracts that are delivered, issued, executed, or renewed on or after that date.
STATEMENT
This bill prohibits the imposition of different premium rates for disability insurance based on race, creed, color, or other protected characteristic.
Under the bill, insurers authorized to issue and insurance producers authorized to sell, solicit, or negotiate policies or contracts against disability and insurers will be prohibited from imposing a higher rate of premium for a policy or contract that is delivered, issued, executed, or renewed in the State on the basis of the applicant's or insured's race, creed, color, national origin, or sex. The bill also provides that a violation of the bill will constitute a violation of the New Jersey consumer fraud act.
