SYNOPSIS
Prohibits court from ordering victims to submit to examinations under certain circumstances.

An Act prohibiting the court from ordering certain examinations of victims and supplementing Title 2A of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. In a prosecution for aggravated sexual assault, sexual assault, aggravated criminal sexual contact, criminal sexual contact, or human trafficking involving sexual activity, the court shall not order or otherwise require the victim to submit to or undergo a gynecological examination or a physical examination of the breasts, buttocks, anus, or any part of the sexual organs.
b. In a civil action for damages arising from any of the crimes set forth in subsection a. of this section, the court shall not order or otherwise require the victim to submit to or undergo a gynecological examination or a physical examination of the breasts, buttocks, anus, or any part of the sexual organs.
c. The refusal of a victim to submit to or undergo an examination set forth in subsection a. or subsection b. of this section shall not serve as the basis to exclude evidence obtained from other relevant examinations of the victim.
2. This act shall take effect on the first day of the fourth month next following the date of enactment.
STATEMENT
This bill prohibits the court from ordering victims to submit to examinations under certain circumstances.
Under the provisions of this bill, in a prosecution for aggravated sexual assault, sexual assault, aggravated criminal sexual contact, criminal sexual contact, or human trafficking involving sexual activity, the court is not to order or otherwise require the victim to submit to or undergo a gynecological examination or a physical examination of the breasts, buttocks, anus, or any part of the sexual organs. In addition, in a civil action for damages arising from any of these crimes, the court is not to order or otherwise require the victim to submit to or undergo these examinations.
The refusal of a victim to submit to or undergo one of these examinations is not to serve as the basis to exclude evidence obtained from other relevant examinations of the victim.
