SYNOPSIS
Permits counties to establish certain weight restrictions on county roads.

An Act concerning weight restrictions on county roads and supplementing Title 27 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. As used in P.L. , c. (C. ) (pending before the Legislature as this bill):
"Gross vehicle weight rating" means the same as that term is defined in R.S.39:10-2.
"Public utility" means the same as that term is defined in R.S.48:2-13.
"Truck" means the same as that term is defined in R.S.39:1-1.
2. The governing body of any county may, by resolution, exclude trucks having a gross vehicle weight rating in excess of four tons from operating on a county road that:
a. is 1.5 miles or less in length;
b. has 100 or fewer residential properties along the road or highway;
c. has two lanes separated by a yellow line;
d. has no curbs or walkways along the road or highway; and
e. has one or more homes built 15 feet or less from the road or highway.
3. Nothing in P.L. , c. (C. ) (pending before the Legislature as this bill) shall be construed to prevent trucks having a gross vehicle weight rating in excess of four tons from making deliveries of merchandise or other property along county roads from which these trucks are excluded or to authorize the exclusion from any county road of trucks used by public utility companies in connection with the construction, installation, operation, or maintenance of public utility facilities.
4. A county that excludes trucks having a gross vehicle weight rating in excess of four tons from operating on a county road pursuant to section 1 of P.L. , c. (C. ) (pending before the Legislature as this bill) shall provide suitable connection with all State routes entering and leaving the county issuing the resolution. A truck having a gross vehicle weight rating in excess of four tons shall not be excluded from any State highway route without the approval of the Commissioner of Transportation.
5. Any resolution excluding trucks having a gross vehicle weight rating in excess of four tons from operating on a county road pursuant to section 1 of P.L. , c. (C. ) (pending before the Legislature as this bill) shall provide for the conspicuous marking of the county road subject to the resolution. The marking shall be by signs so placed and maintained as to clearly show the county road by both day and night and shall designate the weight of the trucks that are excluded from the county road.
6. Any resolution excluding trucks having a gross vehicle weight rating in excess of four tons from operating on a county road pursuant to section 1 of P.L. , c. (C. ) (pending before the Legislature as this bill) shall provide for its enforcement and prescribe the penalties for violations within the limitations imposed by law.
7. This act shall take effect immediately.
STATEMENT
This bill permits counties to establish certain weight restrictions on county roads. Under the bill, the governing body of any county may, by resolution, exclude trucks having a gross vehicle weight rating in excess of four tons from operating on a county road that meets the requirements established in the bill. The bill provides an exception for trucks making deliveries of merchandise or other property, and for trucks used by public utility companies in connection with the construction, installation, operation, or maintenance of public utility facilities.
The bill also requires any resolution excluding trucks having a gross vehicle weight rating in excess of four tons from operating on certain county roads to provide for the conspicuous marking of the county roads subject to the resolution, provide for the resolution's enforcement, and prescribe the penalties for violations within the limitations imposed by law.
