SYNOPSIS

     Prohibits sale of water beads.

An Act concerning water beads and supplementing P.L.1960, c.39 (C.56:8-1 et seq.). 

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  For the purposes of this section, "water beads" means small, round beads made of a water-absorbing polymer substance that, when placed in water, increase in size. 

     b.    1[It shall be an unlawful practice and a violation of P.L.1960, c.39 (C.56:8-1 et seq.) for a] A1 person 1[to] shall not1 sell, offer for sale, or distribute for sale water beads, or any product containing water beads. 

     c.     1Any person who violates the provisions of this section shall be liable to a civil penalty of up to $5,000 for each offense, which may be collected and enforced by the Director of the Division of Consumer Affairs in the Department of Law and Public Safety in a summary proceeding pursuant to the "Penalty Enforcement Law of 1999," P.L.1999, c.274 (C.2A:58-10 et seq.).  If the violation is of a continuing nature, each day during which a violation occurs shall constitute a separate offense.  The Superior Court shall have jurisdiction of proceedings for the enforcement of the penalty provided by this section.  A violation of this section shall not be considered an unlawful practice in violation of P.L.1960, c.39 (C.56:8-1 et seq.).

     d.1 The Director of the Division of Consumer Affairs in the Department of Law and Public Safety, may adopt, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), rules and regulations necessary to effectuate the purposes of this act.

 

     2.    This act shall take effect on the first day of the sixth month next following the date of enactment.
