An Act concerning the recovery by public utilities of certain charges for utility service and supplementing Title 48 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Notwithstanding any law, rule, regulation or order to the contrary, a public utility is prohibited from recovering any underpayments for utility service from a customer, when such underpayments are attributable to malfunctions of a customer's utility meter or equipment related to the utility meter including, but not limited to, electronic meter transmitting devices, if the malfunctions occurred two years or more prior to the date of the public utility's initial attempt to collect the underpayment from a customer.
2. This act shall take effect immediately.
STATEMENT
This bill prohibits any public utility from recovering underpayments for utility service from a customer, when such underpayments are caused by malfunctions of a customer's utility meter or equipment related thereto, including, but not limited to, electronic meter transmitting devices, if the malfunctions occurred two or more years prior to the date on which the utility initially attempts to collect the underpayment from a customer.
