     Prohibits court from requiring victim of sexual offense to submit to certain examinations.

An Act concerning victims of certain sexual offenses and supplementing Title 2A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  In a prosecution for, or civil action for damages arising from, aggravated sexual assault, sexual assault, aggravated criminal sexual contact, criminal sexual contact, or human trafficking involving sexual activity, the court shall not order or otherwise require the victim to submit to or undergo a gynecological examination or a physical examination of the breasts, buttocks, anus, or any part of the sexual organs.

     b.    The refusal of a victim to submit to or undergo an examination set forth in subsection a. of this section shall not serve as the basis to exclude evidence obtained from other relevant examinations of the victim.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill prohibits the court from requiring a victim of a sexual offense to submit to certain examinations.

     Under the provisions of this bill, in a prosecution for, or civil action for damages arising from, aggravated sexual assault, sexual assault, aggravated criminal sexual contact, criminal sexual contact, or human trafficking involving sexual activity, the court is not to order or otherwise require the victim to submit to or undergo a gynecological examination or a physical examination of the breasts, buttocks, anus, or any part of the sexual organs.

     The refusal of a victim to submit to or undergo one of these examinations is not to serve as the basis to exclude evidence obtained from other relevant examinations of the victim.
