SYNOPSIS
Repeals codification of AG directive, "Strengthening Trust Between Law Enforcement and Immigrant Communities."

An Act concerning law enforcement and immigrant communities and repealing P.L.2026, c.5.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. P.L.2026, c.5 (C. ) is repealed.
2. This act shall take effect immediately.
STATEMENT
This bill repeals the law codifying Attorney General directive "Strengthening Trust Between Law Enforcement and Immigrant Communities," P.L.2026, c.5 (C. ). The law prohibits New Jersey's law enforcement officers from engaging in conduct constituting racially-influenced policing or providing certain types of assistance to federal immigration authorities. The law also requires the Attorney General to annually publish instances of permitted assistance to federal immigration authorities by the State's law enforcement agencies. The law further requires law enforcement agencies and officials to: 1) notify detained individuals of certain requests made by federal immigration authorities; and 2) establish procedures for processing requests for certain visa certifications.
The law also sets forth requirements for prosecutors regarding pretrial and trial procedures as well as notification to defendants of possible immigration consequences related to certain charges and convictions.
It is the sponsor's view that the statute hinders federal authority and undermines local policing and prosecutorial discretion.
