     Prohibits MVC from charging fee for restoring driver's license suspended due to mental or physical condition.

An Act concerning the restoration of driver's licenses suspended on the basis of a mental or physical condition and amending P.L.1975, c.180.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 23 of P.L.1975, c.180 (C.39:3-10a) is amended to read as follows:

     23.  The chief administrator shall charge a fee of $100 for the restoration of any license which has been suspended or revoked by reason of the licensee's violation of any law or regulation and for the restoration of vehicle registrations that have been suspended pursuant to any law.  The chief administrator shall not charge a fee for the restoration of any license which has been suspended based upon a determination that a licensee is affected by a mental or physical condition that may compromise the licensee's ability to safely operate a motor vehicle.  The chief administrator may promulgate such regulations hereunder as [he] the chief administrator may deem necessary.

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill prohibits the Chief Administrator of the New Jersey Motor Vehicle Commission from charging a fee for restoring a driver's license that was suspended based upon a determination that a licensee is affected by a mental or physical condition that may compromise the licensee's ability to safely operate a motor vehicle.
