An Act concerning advertisements on school buses and amending P.L.2010, c.121.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 1 of P.L.2010, c.121 (C.18A:39-31) is amended to read as follows:

     1.    a.  (1)  The board of education of any school district may enter into a contract for the sale of advertising space on the exterior sides of school buses owned or leased by the school district and a school bus contractor may enter into a contract for the sale of advertising space on the exterior sides of school buses owned by the contractor, subject to the limitations set forth in this section. Advertisements for tobacco or alcohol products or for political advocacy shall be prohibited, in addition to any other advertisements for products or services or by sponsors that the Commissioner of Education deems inappropriate. [All] In the case of school buses owned or leased by a school district, all advertisements shall require prior approval by the local board of education.

     (2)   In the event that a school bus contractor enters into a contract for the sale of advertising space on school buses pursuant to paragraph (1) of this subsection, the contractor shall share the advertising revenue with the school districts for which the school bus contractor provides pupil transportation services.  The commissioner shall determine the percentage of the revenue that shall be allocated to a school district.

     In each school year, prior to the beginning of transportation of school pupils under a contract awarded by a board of education to a school bus contractor, the contractor shall furnish the executive county superintendent of schools with information on the amount of advertising revenue allocated to that school district pursuant to this paragraph.

     b.    (1)  In the event that a board of education enters into a contract for the sale of advertising space on the exterior sides of school buses pursuant to paragraph (1) of subsection a. of this section, 50% of any revenue generated by the sale shall be used by the board to offset the fuel costs of providing pupil transportation services, and the remaining 50% of the revenue shall be used to support any programs and services the board may deem appropriate.

     (2)   In the event that a board of education receives advertising revenue from a school bus contractor pursuant to paragraph (2) of subsection a. of this section, the revenue shall be used to support any programs and services the board may deem appropriate.

     c.     The provisions of the "Public School Contracts Law," N.J.S.18A:18A-1 et seq., shall apply to any contract entered into by a board of education pursuant to paragraph (1) of subsection a. of this [act] section.

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     P.L.2011, c.121 (C.18A:39-31 et seq.), which was approved on January 5, 2011, authorizes a board of education to enter into a contract for the sale of advertising space on the exterior sides of school buses owned or leased by the school district.  This bill authorizes a school bus contractor to enter into a contract for the sale of advertising space on the exterior sides of school buses owned by the contractor.  If the school bus contractor enters into such a contract, then the contractor is required to share the advertising revenue with the school districts for which the school bus contractor provides pupil transportation services.  The commissioner will determine the percentage of the revenue that will be allocated to a school district.
