SYNOPSIS
Permits municipality in which private golf club holds plenary retail consumption license to issue additional license.

An Act concerning the issuance of alcoholic beverage licenses and amending P.L.1947, c.94 and P.L.1945, c.55.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Section 2 of P.L.1947, c.94 (C.33:1-12.14) is amended to read as follows:
2. Except as otherwise provided in this [act, no] Title, a new plenary retail consumption or seasonal retail consumption license shall not be issued in a municipality unless and until the combined total number of such licenses existing in the municipality is fewer than one for each 3,000 of its population according to the most recent estimates issued by the U.S. Bureau of the Census; provided, however, in the year that the official federal decennial counts are received by the Governor, those federal decennial counts shall be used. [No] A new plenary retail distribution license shall not be issued in a municipality unless and until the number of such licenses existing in the municipality is fewer than one for each 7,500 of its population according to the most recent estimates issued by the U.S. Bureau of the Census; provided, however, in the year that the official federal decennial counts are received by the Governor, those federal decennial counts shall be used.

2. Section 2 of P.L.1945, c.55 (C.33:1-46.2) is amended to read as follows:
a. The director may, subject to rules and regulations, issue special permits to a constituent unit, chartered or otherwise duly enfranchised chapter or member club of a national or state order, organization or association, or to a bona fide golf and country club in the event that the said municipality has failed or neglected to adopt an enabling ordinance as aforesaid, or has failed or neglected to properly act upon an application by such a constituent unit, chartered or otherwise duly enfranchised chapter or member club or a bona fide golf and country club for a club license, as aforesaid; the fee for the same shall be determined in each case by the director and shall not be less nor more than the fee provided for by subsection 5 of R.S. 33:1-12.
b. A municipality in which a privately owned and operated golf club holds a plenary retail consumption license prior to the effective date of P.L. , c. (pending before the Legislature as this bill) may issue one plenary retail consumption license in addition to those permitted pursuant to section 2 of P.L.1947, c.94 (C.33:1-12.14) and those issued prior to effective date of section 4 of P.L.1947, c.94 (C.33:1-12.16). The additional plenary retail consumption license shall be offered at public sale and issued to the highest qualified bidder pursuant to P.L.1981, c.416. (C.33:1-19.3 et seq.).

2. This act shall take effect immediately.
STATEMENT
This bill allows a municipality in which a privately owned and operated golf club holds a plenary retail consumption license to issue one additional consumption license at public sale to the highest bidder.
Under current law, a municipality may issue one plenary retail consumption license (for bars and restaurants) for each 3,000 of its population. This population restriction, however, does not apply to licenses that were issued in excess of this limit within a municipality prior to 1947.
This bill allows a municipality in which a privately owned and operated golf club holds a plenary retail consumption license to issue a consumption license in addition to licenses subject to the population restriction and licenses issued prior to 1947. The bill requires the additional license to be issued at public sale in accordance with current law.
