SYNOPSIS

     Limits easement, acquired by the State or local government unit, for use of beachfront property to dune construction or beach replenishment except under certain circumstances.

An Act concerning easements acquired on beachfront property, and supplementing Title 13 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Except as provided in subsection b. of this section, an easement on a beachfront property acquired by the State or a local government unit for the purpose of dune construction or beach replenishment shall provide for the use of the property only for those purposes and shall not authorize construction of any structure other than a dune, or the use of the property for any other purpose.

     b.  If a structure was present on the beachfront property prior to the acquisition of the easement, the easement may also provide for that use of the property and for the construction, reconstruction, or repair of the preexisting structure.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would provide that if an easement is acquired on beachfront property by the State or a local government unit for the purpose of dune construction or beach replenishment, the easement must be limited to allowing use of the property by the State or local government unit only for dune construction or beach replenishment and not for any other use.  However, the bill also provides that if a structure was present on the property prior to the acquisition, then the easement may also provide for that use of the property and for the construction, reconstruction, or repair of the preexisting structure.
