     Requires contracted service providers who have access to school buildings or grounds when school is not in session to undergo criminal history record check.

An Act concerning criminal history record checks and supplementing P.L.1986, c.116 (C.18A:6-7.1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    In addition to the requirement for a criminal history record check established under section 1 of P.L.1986, c.116 (C.18A:6-7.1), a contracted service provider, including a contractor, subcontractor, or employee of the contractor or subcontractor, who works in any capacity on a school facilities project, and who has access to a public school building or school grounds when school is not in session, shall undergo a criminal history record check in accordance with the procedures established pursuant to P.L.1986, c.116 (C.18A:6-7.1et seq.).

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     Under current law, section 1 of P.L.1986, c.116 (C.18A:6-7.1), a board of education may not employ or contract for the paid services of any individual who will have regular contact with students unless the person has undergone a criminal history record check.  Pursuant to this provision, persons who work on school facilities projects during the course of the school year and have regular contact with students are required to undergo a check.  This bill provides that a contracted service provider, including a contractor, subcontractor, or employee of the contractor or subcontractor, who has access to a public school building or school grounds when school is not in session, will also be required to undergo a criminal history record check.
