SYNOPSIS

     Concerns closure of Fenimore Landfill in Roxbury Twp., Morris County.

An Act concerning the closure of Fenimore Landfill in Roxbury Township, Morris County.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    No more than 15 days after the effective date of this act, the Department of Environmental Protection shall assume responsibility for the proper closure of the Fenimore Landfill in Roxbury Township, Morris County.

 

     2.    Dredged materials, residual materials from wastewater treatment plants, and materials originating from any area of concern at a contaminated site shall not be deposited at, used in connection with the closure of, or transported to the Fenimore Landfill in Roxbury Township, Morris County.

     As used in this section: "area of concern" and "contamination" shall have the same meaning as provided in section 23 of P.L.1993, c.139 (C.58:10B-1); and "contaminated site" means any real property on which there is contamination.

 

     3.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would require that not more than 15 days after the effective date of the bill, the Department of Environmental Protection must assume responsibility for the proper closure of the Fenimore Landfill in Roxbury Township, Morris County.  The bill would also prohibit dredged materials, residual materials from wastewater treatment plants, and materials originating from any area of concern at a contaminated site from being deposited at, used in connection with the closure of, or transported to the Fenimore Landfill.
