Requires State and local public contracts for food services to require compliance with federal food service guidelines

An Act requiring State and local public contracts for food services to require compliance with federal food service guidelines and supplementing various parts of the statutory law.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Notwithstanding the provisions of any other law or rule or regulation to the contrary, any contract or agreement, the cost or contract price of which is to be paid with or out of State funds, to provide food services on any property owned or leased by the State shall require that the food provided under the contract shall comply with the nutrition standards developed by the United States Department of Health and Human Services for the Food Service Guidelines for Federal Facilities, or any successor guidelines, in effect on the date the contract takes effect.

     For each item of food or beverage that does not provide visible nutrition information at the point of purchase, a vendor shall be required to provide a sign in close proximity thereto that clearly discloses the number of calories contained in the food or beverage.

     As used in this section, "food services" means all food and beverages sold in a vending machine, cafeteria, concession stand, or food cart, and foods or beverages purchased to provide to employees or members of the public at events and meetings.

     For each item of food or beverage that does not provide visible nutrition information at the point of purchase, a vendor shall be required to provide a sign in close proximity thereto that clearly discloses the number of calories contained in the food or beverage.

     4.    This act shall take effect immediately.

 

 

STATEMENT

 

     The purpose of this bill is to ensure that nutritious food choices are available to members of the public and public employees when on public premises. This bill provides that any State, county or municipality, or board of education contract to provide food services on public property must require that the food provided under the contract complies with the nutrition standards developed by the United States Department of Health and Human Services for the Food Service Guidelines for Federal Facilities.  For each item of food or beverage that does not provide visible nutrition information at the point of purchase, a vendor would be required to provide a sign that clearly discloses the number of calories contained in the food or beverage. 

     As used in this bill, "food services" means all food and beverages sold in a vending machine, cafeteria, concession stand, or food cart, and foods or beverages purchased to provide to employees or members of the public at events and meetings.
