SYNOPSIS

     Requires State and local government units to grant Statewide permits for construction of hyperloop project to businesses that commit to funding rail transit tunnel under Hudson River.

An Act concerning State and local government units and permits and supplementing Title 52 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    As used in P.L.    , c.    (C.      ) (pending before the Legislature as this bill):

     "Business" means a corporation, sole proprietorship, partnership, corporation that has made an election under Subchapter S of Chapter One of Subtitle A of the Internal Revenue Code of 1986, or any other business entity through which income flows as a distributive share to its owners, limited liability company, nonprofit corporation, or any other form of business organization located either within or outside this State.

     "Hyperloop" means a method of passenger or freight transportation using a reduced air pressure tube or system of tubes through which a pod conveying people or objects may travel free of air resistance or friction at high speed.

     "Permit" means a permit, license, certificate, registration, compliance schedule, or any other form of permission or approval required by law to be issued by a State or local government unit in order for a business to engage in the planning and construction of a hyperloop project, or any other authorization related thereto, whether that authorization is in the form of a permit, approval, license, certification, waiver, letter of interpretation, agreement, or any other executive or administrative decision which allows a business to engage in the planning and construction of a hyperloop project.

     "Trans-Hudson rail tunnel" means a tunnel under the Hudson River between New Jersey and New York that carries a rail transport system.

 

     2.    a.  Notwithstanding any law, rule, regulation, or order to the contrary, a State or local government unit shall grant, or, where applicable, waive the requirements pertaining to, any permit issued by that State or local government unit that is necessary for a business to plan and construct a hyperloop project in this State to a business that commits to fund the planning and construction of a trans-Hudson rail tunnel. Any permit granted pursuant to this subsection shall apply Statewide.

     b.    A permit shall not be granted pursuant to subsection a. of this section until the business has submitted a trans-Hudson rail tunnel project design plan and proof to the Secretary of State, in a form and manner determined by the Secretary of State, that the business has the financial resources available to fund a trans-Hudson rail tunnel and a written commitment to construct the trans-Hudson rail tunnel. A permit shall be revoked if the business fails to begin constructing the trans-Hudson rail tunnel within a reasonable amount of time, to be determined by the Secretary of State.

 

     3.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires a State or local government unit to grant any permit issued by that State or local government unit that is necessary for a business to plan and construct a hyperloop project in this State to a business that commits to fund the planning and construction of a trans-Hudson rail tunnel. Any permit granted pursuant to the provisions of this bill is to apply Statewide.

     The bill provides that a permit is not to be granted by a State or local government unit until the business has submitted a trans-Hudson rail tunnel project design plan and proof to the Secretary of State, in a form and manner determined by the Secretary of State, that the business has the financial resources available to fund a trans-Hudson rail tunnel and a written commitment to construct the trans-Hudson rail tunnel. A permit is to be revoked if the business fails to begin constructing the trans-Hudson rail tunnel within a reasonable amount of time, to be determined by the Secretary of State.
