SYNOPSIS

     Establishes quorum standards for professional licensing entities under certain circumstances.

An Act concerning the membership of certain State entities and supplementing Title 45 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Notwithstanding any other law, rule, or regulation to the contrary, the majority of the members present at a meeting of a professional board, committee or other entity designated in section 1 of P.L.1971, c.60 (C.45:1-2.1), including at a meeting with two members in attendance if one of the members in 1[attendence] attendance1 is the chair of the entity, shall constitute a quorum for the sole purpose of processing applications for licensure that do not require legal review due to adverse information in any statutorily-required criminal history record background check if, after a 90-day period, the entity is1[:

     (1)]1 unable to achieve a quorum 1[due to vacancies in the membership of the entity; or

     (2)   only able to achieve a quorum if every current member of the entity is present for each meeting] in accordance with the statutory requirements governing that entity1.

 

     12.  If, upon expiration of this act, a board, committee, or entity does not have the requisite number of members required to sustain a quorum pursuant to the individual statute governing the board, committee, or entity, the board, committee, or entity shall submit a written report to the Legislature with a recommendation for another board, committee, or entity with which it should be merged.  The report shall be submitted within 30 days of the expiration of section 1 of this act.1

 

     1[2.] 3.1     This act shall take effect immediately. 1Section 1 of this act shall expire one year after the effective date.  Section 2 of this act shall expire on the 31st day after the expiration of section 1.1
