SYNOPSIS
Establishes public-private partnerships to share de-identified traffic data.

An Act establishing public-private partnerships to share certain data and supplementing Title 27 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. As used in this section:
"Commissioner" means the Commissioner of Transportation.
"Data-sharing project" means a project developed, in whole or in part, for the collection, sharing, and utilization of de-identified data pursuant to subsection b. of this section.
"De-identified data" means: data that cannot be reasonably used to infer information about, or otherwise be linked to, an identified or identifiable individual, or a device linked to such an individual, if the controller that possesses the data: (1) takes reasonable measures to ensure that the data cannot be associated with an individual, (2) publicly commits to maintain and use the data only in a de-identified fashion and not to attempt to re-identify the data, and (3) contractually obligates any recipients of the information to comply with the requirements provided in this definition.
"Precise geolocation data" means information derived from technology, including, but not limited to, global positioning system level latitude and longitude coordinates or other mechanisms, that directly identifies the specific location of an individual with precision and accuracy within a radius of 1,750 feet. "Precise geolocation data" does not include the content of communications.
"Public-private partnership agreement" means an agreement entered into by the Department of Transportation and a private entity pursuant to subsection b. of this section for the purpose of permitting a private entity to assume full financial and administrative responsibility for the development, design, delivery, marketing, and implementation of a data-sharing project.
b. The commissioner or the commissioner's designee may, in consultation with the Office of Information Technology, enter into a public-private partnership agreement with a private entity, pursuant to the provisions of this section, that permits the private entity to assume full financial and administrative responsibility for the development of a data-sharing project. The purpose of a data-sharing project shall be to collect, share, and utilize de-identified data, including but not limited to precise geolocation data, to provide motorists and the department with accurate, up-to-to-date information about road closures, driving conditions, and rainfall.
c. All data-sharing projects proposed in accordance with this section shall be submitted to the commissioner or the commissioner's designee for review and approval. The commissioner, in consultation with the Office of Information Technology, shall determine any criteria required for the review and approval process.
d. A private entity that has entered into a public-private partnership agreement pursuant to this section shall adhere to all requirements in P.L. 2023, c.266 (C.56:8-166.4 et seq.), and shall not be considered a State agency, political subdivision, or instrumentality created by a political subdivision under section 10 of P.L.2023, c.266 (C.56:8-166.13).
2. This act shall take effect immediately.
STATEMENT
This bill authorizes the Commissioner of Transportation (commissioner) to establish public-private partnerships to share de-identified traffic data. Under this bill, the commissioner or the commissioner's designee may, in consultation with the Office of Information Technology, enter into a public-private partnership agreement with a private entity that permits the private entity to assume full financial and administrative responsibility for the development of a data-sharing project. The purpose of a data-sharing project is to collect, share, and utilize de-identified data, including but not limited to precise geolocation data, to provide motorists and the Department of Transportation with accurate, up-to-to-date information about road closures, driving conditions, and rainfall. The bill also affirms that a private entity that is part of a public-private partnership is required to follow State data privacy laws.
