SYNOPSIS

     Requires public institution of higher education to provide information on Selective Service registration and inquire on Selective Service registration of prospective students.

An Act concerning enrollment in a public institution of higher education and supplementing chapter 62 of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  A public institution of higher education shall require an applicant for admission to the institution to provide information on the application on whether the applicant is in compliance with the provisions of the "Military Selective Service Act," 50 U.S.C. App. 451 et seq. The application shall include a conspicuous notice that federal law requires almost all males from the ages of 18 through 25 to register under the "Military Selective Service Act" and that State law at N.J.S.18A:71B-6 requires such registration as a precondition for receipt of State student financial aid.

     b.    The Secretary of Higher Education, in consultation with the presidents of the public institutions of higher education, shall develop a uniform format for the questions and notice required to be included on the admissions application pursuant to subsection a. of this section.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     As required by the federal Military Selective Service Act, almost all men from the ages of 18 through 25, including those who are undocumented, must register with the Selective Service. Under this bill, an applicant to a public institution of higher education in the State of New Jersey is required to provide information on the application for admission on whether the applicant has registered with the Selective Service. The application must also provide a conspicuous notice that federal law requires such registration, and that State law requires Selective Service registration as a precondition for receipt of State student financial aid.

     The bill requires the Secretary of Higher Education, in consultation with the presidents of the public institutions, to develop a uniform format for the questions and notice required on Selective Service registration.

     P.L.2013, c.170 (C.18A:62-4.4), which was signed by the Governor on December 20, 2013, allows undocumented students to be eligible for in-State tuition at public institutions of higher education if they meet certain requirements. Given that the State will now allow undocumented students to attend the public institutions at the in-State tuition rate, there should be heightened awareness that federal law requires registration with the Selective Service.
