SYNOPSIS

     Deems certified nurse aides and licensed practical nurses to qualify as certified homemaker-home health aides.

An Act concerning certified homemaker-home health aides and supplementing Titles 45 and 26 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  a.  A person who has been certified as a nurse aide by the Department of Health and Senior Services, or who is licensed as a licensed practical nurse in this State, shall be deemed to meet the qualifications for certification as a homemaker-home health aide by the New Jersey Board of Nursing in the Division of Consumer Affairs of the Department of Law and Public Safety, and shall retain that status as long as the person retains his nurse aide certification or licensure as a practical nurse, as applicable.   

     b.  (1)  The board shall issue homemaker-home health aide certification to a person with respect to whom the department furnishes notification of nurse aide certification pursuant to section 2 of P.L.  , c.   (C.    ) (pending before the Legislature as this bill), or who is licensed as a licensed practical nurse in this State, upon payment of the fee for homemaker-home health aide certification as required pursuant to section 4 of P.L.1989, c.98 (C.45:11-24.1).  The person shall be exempted from the examination requirement for homemaker-home health aide certification.

     (2)  If the board is notified by the department of any revocation, suspension, or termination of a person's nurse aide certification, or if the board revokes, suspends, or terminates a person's practical nurse licensure in this State, the board shall promptly take corresponding action with respect to that person's homemaker-home health aide certification.

 

     2.  The Department of Health and Senior Services shall promptly notify the New Jersey Board of Nursing in the Division of Consumer Affairs of the Department of Law and Public Safety in writing of any nurse aide certification issued by the department and of any revocation, suspension, or termination of that certification, and shall furnish such information as the board deems necessary for the purposes of section 1 of P.L.  , c.   (C.    ) (pending before the Legislature as this bill).

 

     3.    The New Jersey Board of Nursing in the Division of Consumer Affairs of the Department of Law and Public Safety, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), and in consultation with the Department of Health and Senior Services, shall adopt rules and regulations to effectuate the purposes of this act.

 

     4.  This act shall take effect on the 180th day after the date of enactment, but the New Jersey Board of Nursing and Department of Health and Senior Services may take such anticipatory administrative action in advance thereof as shall be necessary for the implementation of this act.

 

 

STATEMENT

 

     This bill deems certified nurse aides and licensed practical nurses to qualify as certified homemaker-home health aides.

     The bill provides specifically as follows:

·   A person who has been certified as a nurse aide by the Department of Health and Senior Services (DHSS), or who is licensed as a licensed practical nurse in this State, is deemed to meet the qualifications for certification as a homemaker-home health aide by the New Jersey Board of Nursing in the Division of Consumer Affairs of the Department of Law and Public Safety, and is to retain that status as long as the person retains his nurse aide certification or licensure as a practical nurse, as applicable.  

·   DHSS is to promptly notify the Board of Nursing in writing of any nurse aide certification issued by DHSS and of any revocation, suspension, or termination of that certification, and is to furnish such information as the board deems necessary for the purposes of this bill.

·   The board is to issue homemaker-home health aide certification to a person with respect to whom DHSS furnishes notification of nurse aide certification, or who is licensed as a licensed practical nurse in this State, upon payment of the fee for homemaker-home health aide certification as required pursuant to section 4 of P.L.1989, c.98 (C.45:11-24.1).  The person is exempted from the examination requirement for homemaker-home health aide certification.

·   If the board is notified by DHSS of any revocation, suspension, or termination of a person's nurse aide certification, or if the board revokes, suspends, or terminates a person's practical nurse licensure in this State, the board is to promptly take corresponding action with respect to that person's homemaker-home health aide certification.

·   The bill takes effect on the 180th day after enactment, but authorizes the board and DHSS to take anticipatory administrative action in advance as necessary for its implementation.
