     Clarifies applicability to primary elections of campaign contribution and expenditures reporting act.

An Act concerning the applicability to certain elections of the campaign contributions and expenditures reporting act and amending P.L.1973, c.83.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  Section 4 of P.L.1973, c.83 (C.19:44A-4) is amended to read as follows:

     4.  The provisions of this act shall apply[:

     a.  (Deleted by amendment; P.L.1981, c.151.)

     b.  (Deleted by amendment; P.L. [1983], c.[ 579].)

     c.  In any election at which a public question is to be voted upon by the voters of the State or any political subdivision thereof;

     d.  In any election for any public office of the State or any political subdivision thereof; provided, however, that this act shall not, except for paragraph (2) of subsection a. of section 8 of the act (C.19:44A-8), apply to elections for party office.] in any election at which candidates are elected, or nominated for election, to any public office of the State or any political subdivision thereof, or any other public body, including but not limited to primary, general, municipal, runoff, school, fire commission, special, or recall elections, and in any election at which a public question is to be voted upon by the voters of the State or any political subdivision thereof, or any other public body.  The provisions of this act shall not apply to elections for party office, except for paragraph (2) of subsection a. of section 8 of P.L.1973, c.83 (C.19:44A-8).

     2.  This act shall take effect immediately.

 

 

STATEMENT

 

     The purpose of this bill is to clarify the applicability of "The New Jersey Campaign Contributions and Expenditures Reporting Act."  A recent court ruling has questioned whether the act applies to primary elections as well as general elections.  This bill would modify the applicability section to make clear that the act does apply to any election at which candidates are elected, or nominated for election, to any public office of the State or any political subdivision, or any other public body, including but not limited to primary, general, municipal, runoff, school, fire commission, special, or recall elections.  The act also applies in any election at which a public question is to be voted upon by the voters of the State or any political subdivision, or any other public body.  The act generally does not apply to elections for party office.

     This bill clarifies that the Legislature intended the "Reporting Act" to include primary elections when the law was enacted in April of 1973.
