An Act concerning hospital licenses and supplementing P.L.1971, c.136 (C.26:2H-1 et seq.).
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. In the event that a general hospital closes and seeks to transfer its license to another entity, the owner of the closed hospital shall: notify the Commissioner of Health and Senior Services of the pending transfer; and provide such information about the pending transfer and the entity to which the transfer is pending, as the commissioner deems necessary.
Prior to authorizing the transfer, which shall be subject to certificate of need requirements, the commissioner shall determine how the entity plans to utilize the license. The commissioner shall not approve a transfer of license unless the entity seeking the license can demonstrate to the satisfaction of the commissioner that the entity intends and has the ability to operate the facility as a hospital.
2. This act shall take effect on May 4, 2009, and if enacted after that date, shall be retroactive to that date.
STATEMENT
