SYNOPSIS

     Permits members of Pinelands Commission to approve revisions to comprehensive management plan.

An Act concerning conflicts of interest of members of the Pinelands Commission and amending P.L.1979, c.111.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 16 of P.L.1979, c.111 (C.13:18A-17) is amended to read as follows:

     16.  a.  No member, officer, employee, or agent of the commission shall take any official action on any matter in which he has a direct or indirect financial interest; provided, however, that the ownership of, or tenancy in, one's own  private residence shall not be considered a financial interest for the purposes of this section; and provided further, however, that nothing in this section shall be construed so as to prohibit any such member from participating in the preparation and approval of the comprehensive management plan or any revision thereof;

     b.    Any commission action taken or approval granted in violation of this section is voidable;

     c.     Any person who shall willfully violate any provision of this section shall forfeit his office or employment and shall be guilty of a misdemeanor and  be punished by a fine of not more than $7,500.00 or by imprisonment for not more than 18 months, or both such fine and imprisonment.

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill clarifies the relationship of the Pinelands Protection Act to the Conflicts of Interest Law concerning the ability of members of the Pinelands Commission to approve revisions to the comprehensive management plan for the pinelands area.

     Presently, a member of the Pinelands Commission is prohibited from taking any official action on any matter in which he has a direct or indirect financial interest.  However, members of the commission are permitted to participate in the preparation and approval of the comprehensive management plan.  This bill clarifies that members of the commission may also participate in the preparation and approval of revisions to the comprehensive management plan without engaging in any conflict of interest.
