SYNOPSIS

     Establishes time limit for execution of arrest warrant for non-moving motor vehicle violations.

An Act concerning non-moving motor vehicle violations and supplementing Title 39 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    In the case of a non-moving motor vehicle violation, if a warrant for the defendant's arrest is not executed within three years of the date of the issuance of the warrant, the warrant shall be void.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill establishes a time limit for the execution of a warrant for a non-moving motor vehicle violation.

     Specifically, under the provisions of this bill, if an arrest warrant for a non-moving motor vehicle violation is not executed within three years of the date that the warrant was issued, the warrant is void.

     Under current law, there is no time limit for executing a warrant for a defendant's arrest resulting from a non-moving motor vehicle violation.
