     Requires municipalities to include unique identifier on signs at certain handicapped parking spots.

An Act concerning handicapped parking and amending P.L.1977, c.309.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 2 of P.L.1977, c.309 (C.39:4-197.7) is amended to read as follows:

     2.    Any municipality enacting an ordinance pursuant to section 1 of [this act] P.L.1977, c.309 (C.39:4-197.6) shall provide for the issuance of permits which identify a specific motor vehicle and the location wherein it is to be parked.  Such permits shall only be issued to persons who can prove ownership and operation of the motor vehicle and residency at the location specified thereon.  The permit shall be 5  1/2 inches by 8  1/2 inches in size, shall bear an appropriate certification of  authenticity and a unique identifying number.  The permit shall be displayed prominently within the vehicle when it is parked so as to be seen from the middle of the street.  A municipality enacting an ordinance pursuant to section 1 of P.L.1977, c.309 (C.39:4-197.6)  shall also place a sign that displays a permit's unique identifying number at the location where the permitted motor vehicle is to be parked.  Only a motor vehicle for which a valid permit has been issued and which has such permit properly displayed shall be permitted to be parked in the restricted parking zone indicated on such permit.  A municipality may, by ordinance, establish a fee for such permits.

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     N.J.S.A.39:4-197.6 permits municipalities, by ordinance, to establish a restricted parking spot in front of a residence of a handicapped person.  This handicapped spot is to be reserved for the motor vehicle that is used to transport the handicapped person. To ensure that only the assigned vehicle uses that spot, this bill would require that the handicapped permit issued for the car and the sign identifying the reserved parking spot display the same number or identifier.
