SYNOPSIS

     Prohibits use of equipment and facilities to produce obscene materials in public school districts and public institutions of higher education.

An Act concerning obscene materials in public school districts and public institutions of higher education and supplementing Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  No classroom, office space, meeting room or equipment, including, but not limited to: computers, printers, copiers, fax machines and paper, owned or leased by a public elementary or secondary school, shall be used to produce obscene materials, as defined in N.J.S. 2C:34-2 and N.J.S. 2C:34-3.

 

     2.  No classroom, office space, meeting room or equipment, including, but not limited to: computers, printers, copiers, fax machines and paper, owned or leased by a public institution of higher education, shall be used to produce obscene materials, as defined in N.J.S. 2C:34-2 and N.J.S. 2C:34-3, except when permission is granted in writing by the institution and is in conjunction with an institution-approved research project or undertaking.

 

     3.  Any person who violates the provisions of this act shall be liable to a civil penalty of not less than $250 for the first violation, not less than $500 for the second violation, and $1,000 for the third and each subsequent violation.  The civil penalty shall be collected pursuant to the  "Penalty Enforcement Law of 1999," P.L. 1999, c.274 (C. 2A:58-10 et seq.), in a summary proceeding instituted by the Attorney General in the name of the State.

 

     4.  This act shall take effect immediately.

 

 

STATEMENT

 

     This bill prohibits the use of classrooms, office space, meeting rooms or equipment owned or leased by public school districts and public institutions of higher education for the production of obscene materials, as defined in N.J.S. 2C:34-2 and N.J.S. 2C:34-3, except when the public institution of higher education grants permission to use such facilities or equipment for an approved research project or other such undertaking.  Such equipment shall include, but is not limited to: computers, printers, copiers, fax machines and paper.

     This bill imposes a civil penalty of not less than $250 for the first violation, not less than $500 for the second violation, and $1,000 for the third and each subsequent violation.  The civil penalty shall be collected pursuant to the "Penalty Enforcement Law of 1999," P.L.1999, c.274 (C. 2A:58-10 et seq.), in a summary proceeding instituted by the Attorney General in the name of the State.
