SYNOPSIS

     Requires county prosecutors to investigate credible allegations of voter intimidation; requires Attorney General to direct investigation if county prosecutor fails to act.

An Act requiring county prosecutors to investigate all allegations of voter intimidation and supplementing chapter 34 of Title 19 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  Notwithstanding the provisions of any other law to the contrary, a county prosecutor, upon receiving credible evidence or information that a violation of section 43 of P.L.1994, c.182 (C.19:34-1.1) or of R.S.19:34-27, 19:34-28, 19:34-29, or 19:34-30 has occurred, regardless of whether a formal complaint has been signed by any person, shall within 48 hours commence a complete and thorough investigation and, in appropriate cases, initiate the prosecution of any person who the prosecutor believes has violated the law.

     If the county prosecutor fails to act as required by this section and the Attorney General receives information that a violation of one of the sections of law enumerated above has occurred, the Attorney General shall give direction for a complete and thorough investigation and, in appropriate cases, initiate the prosecution of any person who the Attorney General believes has violated the law.

 

     2.  This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires a county prosecutor who receives any credible evidence or information that a violation of the laws against voter intimidation has occurred, regardless of whether a formal complaint has been signed by any person, to commence a complete and thorough investigation within 48 hours and, in appropriate cases, initiate the prosecution of any person who the prosecutor believes has violated the law.  It also provides that if the county prosecutor fails to act as required by this section and the Attorney General receives information that a violation of the laws against voter intimidation has occurred, the Attorney General will give direction for a complete and thorough investigation and, in appropriate cases, initiate the prosecution of any person who the Attorney General believes has violated the law.
