SYNOPSIS

     Directs DHS to declare surplus certain unused real property and provides for direct sale thereof.

An Act concerning the sale of certain State property and supplementing P.L.1989, c.110 (C.52:31-1.6 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Notwithstanding the provisions of any other law to the contrary, the Department of Human Services shall declare to be surplus any real property under its control on which improvements consist of a residential treatment center that has not been used by the department to treat clients for a period of at least two years. The Department of the Treasury shall sell and convey all of the State's interest in such real property by direct sale to an organization that agrees to use that real property and the improvements thereon for a period of not less than five years for the purpose of caring for juveniles in State custody or juveniles who have been ordered by a court to undergo treatment.

     The sale and conveyance provided for by this section shall be executed in accordance with terms and conditions approved by the State House Commission.  The proceeds from the sale and conveyance authorized by this section shall be used in accordance with the provisions of the "Community Mental Health and Developmental Disabilities Services Investment Act," P.L.1997, c.258 (C.30:4-177.53 et seq.).

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill directs the Department of Human Services to declare to be surplus any real property under its control on which improvements consist of a residential treatment center that has not been used by the department to treat clients for a period of at least two years.  The Department of the Treasury will sell and convey all of the State's interest in that real property by direct sale to an organization that agrees to use it for a period of not less than five years for the purpose of caring for juveniles in State custody or juveniles who have been ordered by a court to undergo treatment.

     The sale will be in accordance with terms and conditions approved by the State House Commission.  The proceeds from the sale will be used in accordance with the provisions of the "Community Mental Health and Developmental Disabilities Services Investment Act," P.L.1997, c.258 (N.J.S.A.30:4-177.53 et seq.), which provides that  proceeds from the sale of a mental health facility by the State will be used for costs associated with the development of community placement for persons with serious mental illness and developmental disabilities.
