     Permits municipality to publish legal notices in newspaper published in another municipality in certain circumstances.

An Act concerning the publication of municipal legal notices and amending R.S.40:53-2.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

1.      R.S.40:53-2 is amended to read as follows:

     40:53-2.      All ordinances or other public notices which any municipality, except cities, may be required by any law to publish, where the manner of publication is not otherwise specifically provided for, shall be published in at least one newspaper published and circulating in the municipality, and if there be no such newspaper, then in at least one newspaper published in the county in which the municipality is located and circulating in the municipality; provided, however, that any municipality may instead publish all ordinances or other public notices in a newspaper that is published in any other municipality of the State in accordance with the provisions of section 1 of P.L.1944, c.83 (C.35:2-3.1).

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would clarify that a municipality may publish legal notices in a newspaper published in another municipality if the municipal governing body deems such newspaper will inform the greatest number of municipal residents of the municipal governing body's actions.  In those circumstances, a municipality would not have to publish legal notices in a newspaper that is published in that municipality.  Current law is vague as to whether a municipality has the authority to publish its legal notices in a newspaper published in another municipality, with one statute indicating it could not and another arguably indicating it could.  This bill would remove any doubt and clarify that municipalities may publish legal notices in a newspaper published in another municipality if doing so would reach more residents of the municipality publishing the notice.
