     Provides increased representation on receiving district boards of education for certain sending districts.

An Act concerning certain boards of education of school districts involved in sending-receiving relationships and supplementing P.L.1995, c.8 (C.18A:38-8.1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Notwithstanding the provisions of section 2 of P.L.1995, c.8 (C.18A:38-8.2) or any other law or regulation to the contrary, a school district which: is comprised of a municipality that had a population of fewer than 10,000 residents according to the 2000 federal decennial census and had a population growth of greater than 50% between the 1990 and 2000 federal decennial censuses; sends its pupils in grades 9 through 12 to a regional school district in the same county pursuant to N.J.S.18A:38-8; and according to the 2000 federal decennial census is located in a county of the fifth class, shall have representation on the board of education of the receiving district as follows:

     a.     (1) If the pupils of the sending district comprise less than 10% of the total enrollment of the pupils in grades 9 through 12 of the receiving district, the sending district shall have no representation on the receiving district board of education;

     (2)   If the pupils of the sending district comprise at least 10% but not more than 15% of the total enrollment of the pupils in grades 9 through 12 of the receiving district, the sending district shall have one representative on the receiving district board of education;

     (3)   If the pupils of the sending district comprise at least 16% but not more than 39% of the total enrollment of the pupils in grades 9 through 12 of the receiving district, the sending district shall have two representatives on the receiving district board of education; and

     (4)   If the pupils of the sending district comprise at least 40% or more of the total enrollment of the pupils in grades 9 through 12 of the receiving district, the sending district shall have three representatives on the receiving district board of education.

     b.    The calculation of the percentages required under this section shall be based on the number of pupils reported as of the last school day prior to October 16 of the prebudget year.

     c.     The representatives of the sending district board of education shall be designated by the sending district board at a meeting of the board which is closest in time to the annual organizational meeting of the receiving district board of education.

     d.    The representatives of a sending district board of education appointed to a receiving district board of education pursuant to this section shall be in addition to the members of the board of education of a Type I or Type II school district provided pursuant to chapter 12 of Title 18A of the New Jersey Statutes.  The representatives of the sending district board of education shall be eligible to vote on those matters authorized pursuant to section 1 of P.L.1995, c.8 (C.18A:38-8.1).

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that certain sending school districts involved in a sending-receiving relationship will have additional representation on the receiving district's board of education.  If the pupils of the sending district comprise at least 10% but not more than 15% of the total enrollment of the pupils in grades 9 through 12 of the receiving district, the sending district would have one representative on the receiving district board of education.  If the pupils of the sending district comprise at least 16% but not more than 39% of the total enrollment of the pupils in grades 9 through 12 of the receiving district, the sending district would have two representatives on the receiving district board of education.  If the pupils of the sending district comprise at least 40% or more of the total enrollment of the pupils in grades 9 through 12 of the receiving district, the sending district would have three representatives on the receiving district board of education.  If the pupils of the sending district comprise less than 10% of the total enrollment of the pupils in grades 9 through 12 of the receiving district, the sending district would have no representatives on the receiving district board of education, as provided under current law.

     The bill would apply to a district that meets the following criteria: the district is comprised of a municipality that as of the 2000 federal decennial census had a population of fewer than 10,000 residents and a population growth of greater than 50% between the 1990 and 2000 federal decennial censuses; the district sends its pupils in grades 9 through 12 to a regional school district in the same county pursuant to N.J.S.18A:38-8; and according to the 2000 federal decennial census, the district is located in a county of the fifth class.  Under these criteria, the Millstone Township Board of Education would have an additional representative, for a total of three, on the Upper Freehold Regional Board of Education.  The procedures for the selection of sending district members on a receiving district board, and the matters on which the sending district representatives may vote, would remain the same as under current law.
