     Requires counties to fix curbs and surrounding areas when damaged during county road projects.

An Act concerning certain county road projects, amending R.S.27:16-8.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    R.S.27:16-8 is amended to read as follows:

     R.S.27:16-8.  The board of chosen freeholders shall maintain every road laid out, opened, taken over, or acquired by it, between the curb lines, and keep it in repair, safe and convenient for travel during all seasons of the year.  The county, or the board of chosen freeholders, as applicable, shall also repair and maintain any curb and surrounding area damaged or destroyed during any county construction, reconstruction, repair, resurfacing, or rehabilitation of any road.

     2.    This act shall take effect on the first day of the third month following enactment. 

 

 

STATEMENT

 

     This bill requires a county, or the board of chosen freeholders, as applicable, to be responsible for the repair and maintenance of any curb and surrounding area damaged or destroyed during any construction, reconstruction, repair, resurfacing, or rehabilitation of any road undertaken by the county. 

     Current law provides that a county is responsible only for the condition of the roadway and not the curbs or surrounding area, which are often damaged during road projects.
