     Provides that board of education may not exclude students with emotional or behavioral disorders from participating in summer programs.

An Act concerning access to summer programs operated by school districts and supplementing chapter 11 of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    A board of education shall not adopt any policy prohibiting a student with an emotional or behavioral disorder from participating in any program offered by the board during the summer for students residing in the school district.  Nothing in this section shall be construed as requiring the board to waive any participation requirements that are applied to all students. 

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill specifies that a board of education may not adopt a policy to prohibit a student with an emotional or behavioral disorder from participating in summer programming offered by the district for students who live in the district.  The bill's provisions are not to be construed as requiring the board to waive any participation requirements that are applied to all students.
