     Establishes certain ethics protocols for procurement of fire engines.

An Act concerning the procurement of fire engines and supplementing Title 40A of the New Jersey Statutes and Title 52 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    The Division of Fire Safety in the Department of Community Affairs shall adopt rules and regulations to require any member of a paid or volunteer fire company who is also a sales representative for a dealer or manufacturer of fire equipment, or who is employed in any capacity by a dealer or manufacturer of fire equipment, to register with the division, and to recuse themselves from participation in any meetings, discussions, or other activities concerning the procurement of fire engines by the fire company in which they are a member.

 

     2.    Any request for proposals issued by a board of commissioners of a fire district for the procurement of fire engines, apparatus or other appliances for the extinguishment of fires or other emergency response shall require a statement from the bidder attesting that no sales representatives or other employees of the bidder are engaged in any form of collusive activity and are not aware of any conflict of interest in their potential involvement in the procurement process.

 

     3.    Any request for proposals issued by a contracting unit for the procurement of fire engines, apparatus or other appliances for the extinguishment of fires or emergency response shall require a statement from the bidder attesting that no sales representatives or other employees of the bidder are engaged in any form of collusive activity and are not aware of any conflict of interest in their potential involvement in the procurement process.

 

     4.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires any member of a paid or volunteer fire company who is also a sales representative for a dealer or manufacturer of fire equipment, or who is employed in any capacity by a dealer or manufacturer of fire equipment, to register with the Division of Fire Safety in the Department of Community Affairs, and to recuse themselves from participation in any meetings, discussions, or other activities concerning the procurement of fire engines by the fire company in which they are a member.

     The bill also provides that any request for proposals issued by a board of commissioners of a fire district or a contracting unit for the procurement of fire engines, apparatus or other appliances for the extinguishment of fires or for other emergency response shall require a statement from the bidder attesting that no sales representatives or other employees of the bidder are engaged in any form of collusive activity and are not aware of any conflict of interest in their potential involvement in the procurement process.

     This bill implements one of the recommendations made by the State of New Jersey Commission of Investigation in its report Alarming Contracts: Fixed Bids, Conflicts of Interest, Big $ and Lax Transparency in the Purchase of Fire Trucks in New Jersey.
