     Removes proposed exemption from State's pubic records act for certain domestic nonprofit corporations under certain circumstances.

An Act concerning certain domestic nonprofit corporations and supplementing P.L.1948, c.454 (C.27:23-1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  If a domestic nonprofit corporation, organized under the "New Jersey Nonprofit Corporation Act," P.L.1983, c.127 (N.J.S.15A:1-1 et seq.) shall exercise any jurisdiction or control over the tolls charged on the highway or transportation projects of the New Jersey Turnpike Authority or successor corporation or the expressway projects of the South Jersey Transportation Authority or successor corporation, the records of the domestic nonprofit corporation are declared to be public records, and shall be open to public inspection in accordance with P.L.1963, c.73 (C.47:1A-1 et seq.), notwithstanding any law, rule, or regulation to the contrary.

 

     2.  This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that if a domestic nonprofit corporation organized under New Jersey's Nonprofit Corporation Act exercises any jurisdiction or control over the tolls charged on the New Jersey Turnpike, the Garden State Parkway, or the Atlantic City Expressway or other toll road project, the records of the domestic nonprofit corporation are declared public records and are to be open to public inspection in accordance with the State's pubic records law, P.L.1963, c.73 (C.47:1A-1 et seq.).

     This bill is responding to the draft of a bill, the "Financial Restructuring, Debt Reduction and Transportation Infrastructure Act of 2008," posted on the State of New Jersey's website which, as part of Governor Corzine's proposal to authorize a Public Benefit Corporation to increase tolls on the State's tolls roads during the period of a concession agreement, exempts the Public Benefit Corporation, a domestic nonprofit corporation, from any law applicable to an instrumentality of the State, or a political subdivision or an agency, authority or commission of the State.  This bill would specifically apply the State's public record law to such a nonprofit corporation, thereby removing the proposed exemption.
