1.3and transferring duties;proposing coding for new law in Minnesota Statutes,
1.4chapter 383B.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. [383B.76] DISCONTINUANCE OF HENNEPIN CONSERVATION
1.7DISTRICT; TRANSFER OF DUTIES.
1.8(a) Notwithstanding section 103C.225, the Hennepin Conservation District is
1.9discontinued and the duties and authorities of the district under chapter 103C and other
1.10statutory responsibilities are transferred to the Hennepin County Board of Commissioners
1.11operating through the Hennepin County Department of Environmental Services or other
1.12organizational unit as assigned by the county board.
1.13(b) Upon the discontinuance of the Hennepin Conservation District, the Hennepin
1.14County Board of Commissioners operating through the Hennepin County Department of
1.15Environmental Services or other organizational unit as assigned by the county board
1.16retains the eligibility of the Hennepin Conservation District for state grant funds.
1.17(c) Upon the effective date of the discontinuance of the Hennepin Conservation
1.18District, all contracts entered into, to which the district or district board was a party, remain
1.19in force and effect for the period provided in the contracts. The Hennepin County Board
1.20of Commissioners operating through the Hennepin County Department of Environmental
1.21Services or its successors shall be substituted for the district or district board as party to
1.22the contracts and succeed to the district's rights and duties. Any assets of the district on the
1.23date of the discontinuance of the district are transferred to the Hennepin County Board of
1.24Commissioners for the purpose of implementing the transferred duties and responsibilities.
2.1(d) If the Board of Water and Soil Resources finds that the Hennepin County Board
2.2of Commissioners operating through the Hennepin County Department of Environmental
2.3Services or its successors is not sufficiently carrying out the duties and responsibilities of
2.4a soil and water conservation district under chapter 103C, the Board of Water and Soil
2.5Resources may, in order:
2.6(1) reduce, withhold, or redirect grants and other funding if deficiencies have not
2.7been corrected as prescribed in a notice from the Board of Water and Soil Resources
2.8within one year from the date of the notice; and
2.9(2) seek to reestablish the Hennepin Conservation District by legislative action.
2.10 Sec. 2. EFFECTIVE DATE; LOCAL APPROVAL.
2.11Section 1 is effective the day after the governing body of Hennepin County and its
2.12chief clerical officer timely complete their compliance with Minnesota Statutes, section
2.13645.021, subdivisions 2 and 3.
