1.1A bill for an act
1.2relating to elections; modifying vacancy in nominations provisions; amending
1.3Minnesota Statutes 2012, section 204B.13, subdivision 1, by adding a subdivision.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2012, section 204B.13, subdivision 1, is amended to read:
1.6    Subdivision 1. Death or withdrawal Partisan office. A vacancy in nomination
1.7may for a partisan office must be filled in the manner provided by this section. A vacancy
1.8in nomination exists for a partisan office when:
1.9(1) a major political party candidate or nonpartisan candidate who was nominated
1.10at a primary dies or files an affidavit of withdrawal as provided in section 204B.12,
1.11subdivision 2a
; or.
1.12(2) a candidate for a nonpartisan office, for which one or two candidates filed,
1.13withdraws as provided in section 204B.12, subdivision 1.

1.14    Sec. 2. Minnesota Statutes 2012, section 204B.13, is amended by adding a subdivision
1.15to read:
1.16    Subd. 1a. Nonpartisan office. A vacancy in nomination for a nonpartisan office
1.17must be filled in the manner provided by this section. A vacancy in nomination exists when:
1.18(1) a candidate for a nonpartisan office, for which one or two candidates filed,
1.19withdraws as provided in section 204B.12, subdivision 1; or
1.20(2) a candidate for a nonjudicial nonpartisan office dies more than 84 days before
1.21the general election.

1.22    Sec. 3. EFFECTIVE DATE.
2.1Sections 1 and 2 are effective the day following final enactment.
