1.1A bill for an act
1.2relating to taxation; providing contract authority to commissioner of revenue;
1.3regulating abusive transfer pricing schemes.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. TAX COLLECTION; ABUSIVE TRANSFER PRICING SCHEMES.
1.6(a) The commissioner of revenue shall issue a request for proposals for a contract
1.7to enhance the state's ability to identify and collect tax revenues from taxpayers that are
1.8using abusive transfer pricing schemes to reduce the amount of their income subject to
1.9tax under Minnesota Statutes, chapter 290.
1.10(b) The commissioner shall enter into a two-year contract for the services specified in
1.11paragraph (a) by September 1, 2011. The contract must incorporate a performance-based
1.12compensation system whereby the vendor is not paid until tax revenues are collected and
1.13deposited in the state general fund.
1.14(c) An amount sufficient to pay the vendor is appropriated from the general fund
1.15to the Department of Revenue.
1.16EFFECTIVE DATE.This section is effective the day following final enactment.
