1.2relating to transportation; requiring designation of an individual to monitor
1.3compliance with underage drinking laws during transportation provided by a
1.4motor carrier of passengers or limousine service;proposing coding for new
1.5law in Minnesota Statutes, chapter 169.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.7 Section 1. [169.7505] SUPERVISION OF UNDERAGE PASSENGERS IN
1.8MOTOR CARRIERS AND LIMOUSINES.
1.9(a) A motor carrier of passengers, as defined in section 221.012, subdivision
1.1026, that provides charter service and a limousine service, as defined in section 221.84,
1.11subdivision 1, shall, before providing transportation services, require the chartering party
1.12to provide to the motor carrier or limousine service in writing the name, address, and age
1.13of a designee if any passengers will be under 18 years of age and not accompanied by a
1.14parent or legal guardian.
1.15(b) "Designee" means a person:
1.16(1) who is 25 years of age or older;
1.17(2) who shall be present at all times during a motor carrier or limousine trip;
1.18(3) who is provided by the chartering party with the names of passengers under
1.1918 years of age; and
1.20(4) who shall make reasonable attempts to ensure compliance by passengers who
1.21are under 18 years of age with laws concerning controlled substances and underage
1.22consumption of alcoholic beverages.
1.23(c) If, during the transportation, the driver observes possession, use, or consumption
1.24of a controlled substance or an alcoholic beverage by an underage person, or the
1.25designated individual informs the driver that an underaged person has possessed, used, or
2.1consumed a controlled substance or an alcoholic beverage, the trip must be terminated and
2.2the passengers returned to the point where the transportation service commenced.
