1.1A bill for an act
1.2relating to insurance; requiring that health plans that include out-of-network
1.3coverage permit assignment of benefits;proposing coding for new law in
1.4Minnesota Statutes, chapter 62Q.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [62Q.511] POINT-OF-SERVICE OPTION; ASSIGNMENT OF
1.7BENEFITS.
1.8    Subdivision 1. Definitions. (a) For purposes of this section, the terms defined in
1.9this subdivision have the meanings given.
1.10(b) "Point-of-service option" has the meaning given in section 62Q.51, subdivision 1.
1.11(c) "Assignment of benefits" means a provision in a health plan that permits the
1.12insured or other covered person to assign to a health care provider the right to submit
1.13a claim to the health plan company for payment, subject to any applicable enrollee
1.14cost-sharing.
1.15    Subd. 2. Assignment of benefits required; certain health plans. A health plan
1.16that provides coverage for care received outside of the health plan's provider network
1.17must permit enrollees to assign benefits to the out-of-network provider that provided
1.18the out-of-network care.
1.19EFFECTIVE DATE.This section is effective for health plans offered, issued,
1.20or renewed on or after January 1, 2012.
