1.2relating to public safety; authorizing certain retired peace officers to carry a pistol
1.3without a permit; requiring law enforcement agencies to issue identification to
1.4former officers who qualify to carry without a permit; amending Minnesota
1.5Statutes 2012, section 624.714, subdivision 13.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.7 Section 1. Minnesota Statutes 2012, section 624.714, subdivision 13, is amended to read:
1.8 Subd. 13. Exemptions; adult correctional facility officers, retired peace officers.
1.9(a) As used in this subdivision, "law enforcement agency" and "peace officer" have the
1.10meanings given in section 626.84, subdivision 1.
1.11(b) A permit to carry a pistol is not required of: (1) any officer of a state adult
1.12correctional facility when on guard duty or otherwise engaged in an assigned duty.; or (2)
1.13a person who: (i) within the past five years has received the training in the safe use of a
1.14pistol described in subdivision 2a; and (ii) was a peace officer and retired or separated
1.15from service in good standing from a law enforcement agency, other than for reasons of
1.16mental illness or chemical dependency, after being regularly employed as a peace officer
1.17for at least 15 years or for any period beyond the agency's probationary period if the
1.18person retired or separated from service due to a service-related disability.
1.19(c) A law enforcement agency shall issue a photographic identification to a person
1.20who retired or separated from service from the agency and who meets the criteria described
1.21in paragraph (b), clause (2), item (ii). The agency may charge the person a processing fee
1.22not to exceed the actual and reasonable direct cost to the agency of issuing the identification.
