1.1A bill for an act
1.2relating to data practices; classifying crime prevention program security data;
1.3amending Minnesota Statutes 2012, section 13.37, subdivision 1.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2012, section 13.37, subdivision 1, is amended to read:
1.6    Subdivision 1. Definitions. As used in this section, the following terms have the
1.7meanings given them.
1.8(a) "Security information" means government data the disclosure of which
1.9the responsible authority determines would be likely to substantially jeopardize the
1.10security of information, possessions, individuals or property against theft, tampering,
1.11improper use, attempted escape, illegal disclosure, trespass, or physical injury. "Security
1.12information" includes crime prevention block maps and lists of volunteers who participate
1.13in community crime prevention programs and their home and mailing addresses and,
1.14 telephone numbers, and e-mail or other digital addresses.
1.15(b) "Trade secret information" means government data, including a formula, pattern,
1.16compilation, program, device, method, technique or process (1) that was supplied by the
1.17affected individual or organization, (2) that is the subject of efforts by the individual or
1.18organization that are reasonable under the circumstances to maintain its secrecy, and (3)
1.19that derives independent economic value, actual or potential, from not being generally
1.20known to, and not being readily ascertainable by proper means by, other persons who can
1.21obtain economic value from its disclosure or use.
1.22(c) "Labor relations information" means management positions on economic and
1.23noneconomic items that have not been presented during the collective bargaining process
2.1or interest arbitration, including information specifically collected or created to prepare
2.2the management position.
2.3(d) "Parking space leasing data" means the following government data on an
2.4applicant for, or lessee of, a parking space: residence address, home telephone number,
2.5beginning and ending work hours, place of employment, work telephone number, and
2.6location of the parking space.
