1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. CONVEYANCE OF PUBLIC LANDS; PRIVATE SALE OF SURPLUS
1.6LANDS; AITKIN COUNTY.
1.7 Subdivision 1. Conveyance of public lands. Laws 2006, chapter 272, authorized a
1.8town or city within Aitkin County or Aitkin County to regulate the use of lands located
1.9within Aitkin County adjacent to public waters and dedicated to the public or for public
1.10use, but not owned by the state or held in the corporate name of a home rule charter or
1.11statutory city or other political subdivision. No town or city within Aitkin County or
1.12Aitkin County acted to adopt ordinances or regulate the lands described. The land subject
1.13to Laws 2006, chapter 272, as described in subdivision 2, paragraph (c), is now owned by
1.14the state of Minnesota and is hereby transferred to the commissioner of natural resources
1.15for administration and management.
1.16 Subd. 2. Private sale of surplus lands. (a) Notwithstanding Minnesota Statutes,
1.17sections 92.45, 94.09, and 94.10, the commissioner of natural resources shall sell by
1.18private sale to the adjoining landowners the land bordering public water that is described
1.19in paragraph (c).
1.20(b) The conveyance must be in a form approved by the attorney general for
1.21consideration of $1 per parcel and shall be free of any restriction that the land be used
1.22for a public purpose. The attorney general may make necessary changes to the legal
1.23description to correct errors and ensure accuracy.
1.24(c) The land to be sold is in Aitkin County and is described as:
2.1That part of Government Lots 1, 2, 3, and 4 and the East Half of the Northeast
2.2Quarter, all of the Northwest Quarter of the Northeast Quarter, and the West Half of
2.3the Southeast Quarter, all in Section 27, Township 49 North, Range 23 West of the 4th
2.4Principal Meridian, adjacent to Duck Pass and platted as common.
2.5(d) The land borders Lake Minnewawa and is not contiguous to other state lands.
2.6The state's land management interests would best be served if the land was returned to
2.7private ownership.
2.8 Sec. 2. REPEALER.
2.9Laws 2006, chapter 272, sections 1 and 2, are repealed.
